Terms of Use
1. Acceptance of Terms
By downloading, accessing, or using FormShift, creating an account, or completing a purchase, you agree to these Terms of Use (“Terms”) and our Privacy Policy. If you do not agree, do not use the app.
FormShift is operated by Mehmet Kumdakcı, an individual developer. Odd Space Projects is a studio/project brand and is not a registered company or legal entity. No registered company or sole proprietorship currently operates FormShift.
2. Eligibility
You must be at least 18 years old to use FormShift. By using the app, you represent that you meet this requirement.
3. The Service
FormShift provides AI-generated illustrative visualizations of possible body transformations based on photos and information you supply, together with related on-screen analysis and guidance content.
FormShift:
- does not provide medical advice, diagnosis, or treatment;
- does not provide professional nutrition or fitness coaching;
- does not guarantee any real-world change in appearance, weight, strength, or health.
Always consult a qualified professional before starting a new diet, training, or health program.
4. Accounts and Sign-In
Access to credits, purchases, and account features requires Sign in with Apple.
The current iOS app does not offer Google sign-in or email/password registration.
You are responsible for maintaining control of the Apple ID you use with FormShift and for activity under your account.
5. Credits and In-App Purchases (Not Subscriptions)
FormShift uses consumable transformation credits, not auto-renewing subscriptions.
- Credits are purchased through the Apple App Store as in-app purchases.
- The current product grants a fixed number of credits per purchase (for example, a pack that unlocks multiple transformations). Exact pack size and price are shown in the app and in App Store product information at the time of purchase.
- Each successful generation consumes credits as described in the app (typically one credit per generation).
- Credits are tied to your FormShift account after purchase confirmation.
- Credits do not constitute a subscription and do not auto-renew.
Payments are charged to your Apple ID. Billing, taxes, and refunds for App Store purchases are handled under Apple’s terms and refund policies. FormShift does not process card payments directly inside the app.
If a purchase succeeds in the App Store but credits are not immediately reflected, use the in-app retry/confirmation flow where available, or contact support with your Apple purchase details.
6. AI-Generated Content — Illustrative Only
All generated images and related text outputs are illustrative estimates created by automated systems. They:
- are not predictions or guarantees of your future appearance;
- may be inaccurate, incomplete, or contain visual artifacts;
- must not be relied on as medical, scientific, or professional advice;
- may differ from results other users receive because of photo quality, body inputs, goals, timelines, and model behavior.
You understand that real-world outcomes depend on many factors outside the app, including training, nutrition, recovery, genetics, age, and lifestyle.
7. Photos and User Content
You may upload or capture photos and enter personal information only if:
- you own the content or have all rights and permissions needed to use it with FormShift; and
- the content does not violate law or these Terms.
You retain ownership of photos you provide. You grant FormShift a limited license to transmit, process, and temporarily store content as needed to operate the service (including sending the front photo and inputs to our AI provider to fulfill a generation request, and temporarily storing generated results for recovery as described in the Privacy Policy).
Do not upload photos of minors or of other people without lawful permission.
8. Prohibited Use
You agree not to:
- use FormShift if you are under 18;
- upload unlawful, harmful, or infringing content;
- use the service to deceive, harass, exploit, or impersonate others;
- attempt to reverse engineer, scrape, abuse, or disrupt the service;
- bypass credit, authentication, or security controls;
- misrepresent AI outputs as authentic photographs of real future results, medical evidence, or guaranteed outcomes.
We may suspend or terminate access for violations or to protect users, the service, or third parties.
9. Intellectual Property
FormShift, including its software, branding, and original materials we provide, is owned by FormShift or its licensors. Except for your own uploaded content, these Terms do not transfer ownership of our intellectual property to you.
You may use the app for personal, non-commercial purposes in accordance with these Terms and the App Store rules.
10. Third-Party Services
The app relies on third parties such as Apple (Sign in with Apple, App Store), purchase infrastructure (for example RevenueCat), cloud hosting, and AI processing providers. Your use of those platforms may also be subject to their terms. FormShift is not responsible for outages or policy changes of third-party platforms beyond our reasonable control.
11. Service Availability and Changes
We may modify, suspend, or discontinue features, credit packs, or the service as a whole. We do not guarantee uninterrupted or error-free operation. Prior results or features are not a promise of future availability.
12. Account Deletion and Termination
You may delete your account from within the app where that option is provided. Deletion anonymizes your account and removes associated generation recovery data and local app data as described in the Privacy Policy. Some purchase or ledger records may be retained for legitimate business, security, and legal reasons.
We may suspend or terminate accounts that violate these Terms or applicable law.
13. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORMSHIFT IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
AI OUTPUTS ARE ILLUSTRATIVE ONLY AND ARE NOT WARRANTED TO BE ACCURATE OR FIT FOR ANY HEALTH, FITNESS, OR PROFESSIONAL PURPOSE.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEHMET KUMDAKCI AND FORMSHIFT WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR RELIANCE ON AI-GENERATED CONTENT.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO FORMSHIFT VIA THE APP STORE FOR CREDITS IN THE THREE (3) MONTHS BEFORE THE CLAIM OR (B) ZERO IF YOU HAVE NOT PAID, EXCEPT WHERE LIABILITY CANNOT BE LIMITED UNDER APPLICABLE LAW.
Some jurisdictions do not allow certain limitations; in those cases, the limitation applies to the fullest extent permitted.
15. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless Mehmet Kumdakcı and FormShift from claims arising out of your misuse of the service, your content, or your violation of these Terms or applicable law.
16. Governing Law
These Terms are governed by the laws applicable to Mehmet Kumdakcı as the individual developer who operates FormShift, without regard to conflict-of-law rules, except where mandatory consumer protections in your country of residence apply.
No registered company, sole proprietorship, or business postal address is stated in these Terms. Do not treat “Odd Space Projects” as a contracting party.
17. Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms with a revised effective date. Continued use after the effective date constitutes acceptance, except where applicable law requires additional consent.
